Terms and Conditions

1. Purpose and Scope


These Terms and Conditions govern the contractual relationship between LUPUNA JUNGLE TOURS, hereinafter referred to as “The Operator,” and the individual or legal entity contracting the tourist services, hereinafter referred to as “The Client.”
The reservation is formalized through partial or full payment of the selected program. By making payment, The Client confirms that they have read, understood, and accepted these Terms and Conditions.

2. Expedition, Itinerary, and Service Conditions

2.1. Nature of the Tourist Services

 

The Client understands that the contracted services may take place in urban, rural, natural, cultural, river, protected, or remote jungle environments.
The itineraries presented on the website, brochures, or booking documents are for reference purposes.

2.2. Changes to the Itinerary

 

The Operator will make every reasonable effort to carry out the itinerary as originally planned.
However, the order, duration, route, or content of the activities may be modified when necessary to protect the safety of passengers or guarantee the operational feasibility of the service.

Possible reasons include:

  • Adverse weather conditions.

  • Critical rises or drops in river water levels.

  • Restrictions issued by competent authorities.

  • Regulations of protected natural areas.

  • Route or destination closures.

  • Force majeure events.

  • Situations that may place passengers, staff, or equipment at risk.


2.3. Wildlife Sightings
 

The Operator guarantees the necessary logistics, transportation, guiding services, and infrastructure for wildlife observation activities.
However, because wildlife moves freely in its natural environment, the sighting of specific animal species cannot be guaranteed.


2.4. Services Not Included
 

Any activity, meal, beverage, entrance fee, transportation, equipment, or service not expressly listed as included in the itinerary shall be considered excluded and must be paid for by The Client.
 

3. Reservations and Payments


3.1. Reservation Confirmation
 

A reservation will be formally confirmed only after The Operator receives proof of payment corresponding to 30% of the total program price.
Reservations remain subject to availability until the required payment has been received and verified.

 

3.2. Outstanding Balance
 

The remaining balance must be paid in full before the start of the tourist service or at check-in at The Operator’s office or facilities, unless another payment arrangement has been confirmed in writing.
 

3.3. Payment Methods
 

The Operator may accept:

  • Bank transfers.

  • Cash payments.

  • Credit cards.

  • Debit cards.

  • Other payment methods previously confirmed by The Operator.

 

Bank commissions, international transfer charges, currency conversion fees, or electronic payment processing fees shall be paid by The Client.

 

4. User Code and Travel Documentation
 

4.1. User Identification Code
 

Once the reservation has been confirmed, The Operator may assign The Client a Unique User Code.
This code may be used for registration, operational control, equipment allocation, payment verification, and identification during the tourist service.

 

4.2. Payment Receipt
 

After verifying the partial or full payment, The Operator will issue the corresponding payment receipt or invoice associated with the reservation or user code.
 

4.3. Delivery of the Itinerary
 

The Client will receive the detailed itinerary in printed or digital format.
 

The itinerary will indicate:

  • Scheduled activities.

  • Approximate schedules.

  • Transportation and logistics.

  • Services included.

  • Services not included.

  • Relevant recommendations for the trip.

5. Cancellation, Rescheduling, and Refund Policy
 

All cancellation or rescheduling requests must be communicated in writing through The Operator’s official email address or authorized instant messaging channel.
 

The following conditions apply:
 

Cancellation 30 days or more before the start date:
Administrative and operating retention: 10% of the total program price.

Refund to The Client: 90%.
 

Cancellation between 15 and 29 days before the start date:
Retention: 50% of the total program price.
Refund to The Client: 50%.
 

Cancellation less than 15 days before the start date:
Retention: 100% of the total program price.
Refund to The Client: 0% — no refund.

 

No Show:
A “No Show” occurs when The Client does not appear at the agreed place and time and has not provided prior written notice.
Retention: 100% of the total program price.

Refund to The Client: 0% — no refund.
 

5.1. Force Majeure and Adverse Natural Conditions
 

If the service cannot be performed due to natural disasters, route blockages, public health emergencies, strikes, official closures, government restrictions, or other force majeure events, The Operator will issue a Credit Note equivalent to the amount paid.
 

The Credit Note:

  • Will remain valid for twelve months from the date of issuance.

  • May be used to reschedule the contracted service, subject to availability.

  • Is not redeemable for cash.

  • No cash refund will be issued under these extraordinary circumstances.

 

6. Equipment and Implements
 

6.1. Delivery and Condition
 

The Operator may provide life jackets, boots, raincoats, camping equipment, or other implements required for the program.
The Client receives these items in clean and usable condition and must inspect them when they are delivered.

 

6.2. Custody and Proper Use
 

The Client is responsible for the custody and proper use of all assigned equipment during the tour.
The equipment must be used exclusively for its intended purpose.

 

6.3. Loss or Damage
 

If equipment is lost, misplaced, stolen, or damaged due to misuse, carelessness, or negligence by The Client, The Client must pay the corresponding repair or commercial replacement cost.
 

7. Health, Safety, and Personal Property
 

7.1. Health and Physical Condition
 

The Client confirms that they are physically and mentally able to participate in the contracted activities.
 

  • Before confirming the reservation, The Client must inform The Operator in writing of:

  • Pre-existing medical conditions.

  • Physical limitations or injuries.

  • Severe allergies.

  • Dietary restrictions.

  • Medication requirements.

  • Any circumstance that may affect their participation.

  • Failure to disclose relevant medical information may limit The Operator’s ability to provide appropriate assistance.

 

7.2. First-Aid Assistance
 

The Operator carries a basic first-aid kit for minor emergencies.
Personal or specialized medication must be carried and administered under The Client’s responsibility.

 

7.3. Personal Belongings
 

The Client is responsible for the care and custody of their personal belongings.
 

The Operator shall not be responsible for the loss, theft, misplacement, deterioration, or damage of:

  • Mobile phones.

  • Cameras.

  • Electronic equipment.

  • Navigation devices.

  • Money, jewelry, or documents.

  • Any other personal property.

 

8. Conduct and Environmental Protection
 

8.1. Sustainability and Biodiversity
 

The Client agrees to:

  • Respect wildlife, vegetation, communities, and protected areas.

  • Comply with the “Leave No Trace” or “Zero Waste” policy.

  • Properly dispose of or take back inorganic waste.

  • Follow the guide’s schedules, safety instructions, and operational directions.

  • Avoid conduct that may damage the environment or disturb wildlife.

 

8.2. Disciplinary Measures
 

The guide or authorized representative may remove The Client from the program when The Client:

  • Endangers their own safety or the safety of others.

  • Refuses to follow safety instructions.

  • Engages in violent, threatening, or seriously inappropriate behavior.

  • Violates conservation regulations.

  • Damages equipment, property, wildlife, or the natural environment.

  • Interferes with the proper operation of the tour.

 

8.3. No Refund After Removal
 

Removal from the program due to serious misconduct will not entitle The Client to compensation, indemnification, or a refund.
The amount paid may be retained due to the serious breach of the service conditions.

 

9. Image Rights
 

The Operator may capture photographs, videos, or audio recordings during the tourist service and use them for promotional, advertising, commercial, or institutional purposes.
 

These materials may be published on:

  • Official websites.

  • Social media.

  • Digital advertisements.

  • Brochures and catalogs.

  • Other promotional channels.

  • Clients who do not authorize the use of their image must notify The Operator in writing before the tourist service begins.

 

10. Applicable Law and Jurisdiction
 

These Terms and Conditions are governed by the laws of the Republic of Peru.
Any disagreement or dispute related to the interpretation, performance, or enforcement of these conditions shall be submitted to the competent Judges and Courts of the Province of Maynas, Department of Loreto, unless mandatory consumer protection regulations establish otherwise.
